There are several ways to come to an amicable agreement on a divorce. It could be realised with the help of an certified Family Court Mediator, who will help you to work out a balanced settlement. This agreement will then be ratified by the Family Court. One may also opt for ‘collaborative negotiations’.
At BAAKN we have Certified Family Mediators who can guide you and your ex-partner through your divorce. Both parties must want to enter into such a process.
At BAAKN, we will always try to reach an amicable settlement, even outside of a mediation process. By conducting negotiations with your ex-partner (or his/her lawyer), we can work towards a divorce by mutual consent. This agreement may then be ratified by the court.
If an amicable settlement cannot be reached (for whatever reason), BAAKN will initiate legal proceedings before the Family Court. In order to divorce, several conditions must be met.
If these are met, the marriage will be dissolved and a notary will be appointed, who will proceed with the liquidation and division of the marital community. The court will also impose a settlement regarding the minor children. Even then, BAAKN will always try to work out (even partial) agreements, to the extent possible.
